Sidney Powell says ‘no reasonable person’ would believe Dominion claims

A former lawyer for Donald Trump has moved to have a defamation suit against her dismissed on the grounds her words about the US election were not to be believed.

Lawyer Sidney Powell has argued in a motion to dismiss the suit, filed by Dominion Voting Systems, that “no reasonable person” would have believed her claims were “statements of fact”.

The company sued Ms Powell for $US1.3 billion ($A1.7 billion) in January over her claims the company had been involved in an international communist conspiracy to rig the US Presidential election.

Dominion, a voting infrastructure company, claims Ms Powell defamed them by making election fraud accusations that were false and damaging to their company.

Ms Powell made numerous claims about the company during television appearances as she pursued lawsuits over election results for then President Trump.

Dominion’s lawsuit against Ms Powell outlines her appearances on TV and posts online, and her repetition of beliefs Dominion was linked to communist Venezuela. She also claimed officials from the state of Georgia had been involved in election fraud.

In the new filing, Ms Powell’s lawyers argued she’s been sharing her “opinion” and the public were left to reach their “own conclusions” about what happened to their votes.

“Given the highly charged and political context of the statements, it is clear that Powell was describing the facts on which she based the lawsuits she filed in support of President Trump,” her lawyers wrote in a filing on Monday.

“Indeed, Plaintiffs themselves characterise the statements at issue as ‘wild accusations’ and ‘outlandish claims.’ They are repeatedly labelled ‘inherently improbable’ and even ‘impossible.’

“Such characterisations of the allegedly defamatory statements further support Defendants’ position that reasonable people would not accept such statements as fact but view them only as claims that await testing by the courts through the adversary process.”

She also claimed Dominion put together a “well-orchestrated public relations campaign to save their business” and the allegations against her were “sparse”.

Ms Powell’s legal team further requested if the case wasn’t dismissed, it be moved from Washington D.C. to Texas.

Election authorities and Dominion came to the conclusion Mr Trump lost the US election. They concluded the election was not compromised by major security breaches or fraud.

Ms Powell’s legal defence was called “pathetic” by Peter Meijer, a Republican Congressman from Michigan.

“Absolutely infuriating. GOP lost the Senate. 5 ppl died in attack on the Capitol in part bc Sidney Powell misled millions claiming stolen elections,” Mr Meijer wrote on Twitter.

“Now Powell backtracks saying “no reasonable person” wld believe what she *ALLEGED IN COURT* were “statements of fact”!?! Pathetic.”

Following Ms Powell unsubstantiated claims about the company and the US election, more than 4000 US lawyers signed an open letter urging bar disciplinary authorities to investigate their conduct.

Ms Powell, and Mr Trump’s legal team led by Rudy Giuliani, lost 35 legal cases attempting to overturn election results after the US election.
